Daily Compliance Brief — Treasury Imposes First OISP Penalty for Undisclosed China AI Investment

October 7, 2026

Signal

The U.S. Department of the Treasury announced on October 7, 2026 its first civil penalty under the Outbound Investment Security Program (OISP), imposing a $200,000 penalty on Amidi, LLC for failing to submit a required notification concerning an investment in a Chinese artificial intelligence company. According to a U.S. Treasury press release, the penalty relates to an investment made by Amidi's controlled foreign entity.

Treasury stated that the investment involved approximately $92,478 placed in Shanghai Qiongche Intelligent Technology Company Limited, a Chinese company developing artificial intelligence, robotics, and embodied intelligence. The OISP requires notification for certain covered investments involving China and prohibits specified investments in designated technology sectors.

Why it matters

The action establishes an enforcement precedent for compliance with U.S. outbound investment controls and demonstrates that notification failures can result in civil penalties even where the underlying transaction is not prohibited.

Investment, legal, and compliance functions may need to validate notification obligations for controlled foreign entities and strengthen transaction-level screening for covered investments involving China and regulated technology sectors.
